NGOs intending to receive funds and donations from other countries should first register under the provisions of Foreign Contribution Regulation Act, 1976. The NGOs cannot take foreign contribution directly. For this purpose they should be registered under the Foreign Contribution Regulation Act 1976, commonly known as the FCRA. There can be two types of contribution from the foreign source, i.e. one time or expected more than once and even regularly. For any one time contribution the NGOs can receive the amount by seeking prior permission of the FCRA Section of the Ministry of Home Affairs, Government of India; whereas for multiple and regular contributions of the foreign source it is advisable to seek permanent registration from the said Ministry.
The FCRA is generally granted to organisations that have given in minimum 3 years of work in the chosen field of work.
Receive funds from across the world on a one time or a multi time basis and accordingly obtain permission or registration.
Section 12A & 80G registrations are another requirement to get registered under The Foreign Contribution Regulation Act to receive foreign funds.
The FCRA is granted only to such association, which has proven track record of functioning in the chosen field of work.
NGO’s having no track record may receive foreign contribution after seeking project based permission from the Ministry of Home Affairs.
It is essential to receive foreign contribution in one bank account. The organisation should open a bank account for the purpose and mention it in the application.
The application for Registration in Form FC-3 to be filed online.
After compiling the required documents, the documents should be uploaded along with the online form.
The prescribed fees to be paid online and the application to be submitted.
On verifying the above documents, the Ministry shall issue the FCRA within 90 days from the date of submission of online application.
